Terms of Use

1. Agreement

“The Site” means whatlearningbuilds.org and its pages, tools, and downloadable files. The Site is operated by its author, Matthew A. Zinn (“the operator”). By using the Site you accept these Terms together with the Privacy Policy and Accessibility Statement.

2. Educational use only — no professional advice

The Site's frameworks, examples, scenarios, tools, and downloads are offered for reflection and professional learning. Nothing on the Site constitutes legal, medical, psychological, special-education, or other professional advice, and nothing here substitutes for the judgment of qualified professionals, the policies of your school or district, or the laws and regulations that apply to your specific context. Check your school or district's policies before applying any material to a specific student, classroom, or institution.

3. Audiences

The Site is written for adult educators, and nothing on it is offered as a student resource. Demonstration pieces— including the Fair-Share Factory game—are teacher-facing showcases of what can be built, and the downloadable classroom materials are for educators to adapt under their own school or district's policies. The Site does not knowingly collect personal information from children; see the Privacy Policy.

4. Intellectual property and your license

The original writing, media, code, tools, and downloadable classroom files on the Site are the operator's intellectual property. Unless an item is marked otherwise, this original educational content is licensed to you under Creative Commons BY-NC 4.0: you may share, adapt, and remix it for non-commercial purposes with credit, an indication of changes, and no suggestion of endorsement. This license does not extend to (a) the Site's name and branding; (b) third-party content, names, or marks that appear with credit and remain their owners' property; or (c) any use that misrepresents authorship, removes attribution, or implies endorsement by the operator or by any school, district, or employer. For commercial or institutional licensing, use the contact route in Section 10.

5. AI-generated content disclosure

Portions of the Site's media and materials were produced with generative AI tools and are labeled in place where they appear. The Credits & AI Disclosures page documents what was AI-generated, with what category of tool, and under whose review.

The Site links to research, journalism, standards documents, and third-party tools. Those destinations are governed by their own terms and policies; linking is not an endorsement, and the operator is not responsible for their content.

If you believe material on the Site infringes your copyright, send a written notice through the contact route in Section 10 identifying the work, the material at issue and where it appears (a URL is best), your contact information, and your signature.

9. Disclaimer of warranties; limitation of liability

The Site is provided “as is” and “as available,” without warranties of any kind. To the fullest extent permitted by law, the operator is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising from use of the Site; where liability cannot be excluded, the operator's aggregate liability is limited to one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

10. Contact, changes, and severability

By design, the Site offers no email channel. Questions — including copyright concerns under Section 8 — can be raised with the author in person at the sessions the Site accompanies. Revisions to these Terms are reflected in the “Last updated” date above. If any provision of these Terms is found unenforceable, it will be limited to the minimum extent necessary and the remainder will stay in effect.
